Arbitration is a non-court procedure in which the dispute is resolved using one or more neutral third parties called the arbitrator or arbitration panel. Arbitration uses rules of evidence and procedure that are less formal than those followed in trial courts, which frequently leads to a resolution which requires less time and expense. The major difference between arbitration and mediation is that the arbitrator or arbitration panel has the power to impose a binding decision on the parties. Essentially, less focus is on the parties resolving the matter themselves – the arbitrator acts much as a judge would in court.
